Legal
Terms of use
What these terms cover, and what they do not
These terms cover your use of idcarefinder.com: reading it, and using the two enquiry forms.
They do not cover:
-
The Finder software itself. If your institution uses Finder, the terms are in the contract your institution signed. Nothing on this page changes it, and where the two differ, the contract governs.
-
A customer portal. There is none. This site has no accounts, no login and no restricted area. The training, help centre and support areas described in Idcare Digital’s product material are a later phase, and this page will be extended before any of them opens.
That second point is worth stating plainly rather than pre-emptively drafting around. The original specification for this page assumed accounts, acceptable-use rules for a community area, and content ownership for material users upload. Publishing terms for all of that today would describe a service nobody can log into, which is a worse defect in a legal page than an absence: a reader cannot tell which parts are real.
[TO CONFIRM: whether your adviser prefers to publish forward-looking portal terms now, clearly marked as taking effect when the portal opens. This draft argues against it, but it is a legitimate choice and some procurement processes ask to see the terms in advance.]
Using this website
You may read, print and quote these pages with attribution.
Please do not:
-
submit the forms by automated means, or use them to send messages to anyone but us;
-
attempt to disrupt or probe the site’s operation;
-
extract the content systematically to build a competing database or to train a system that competes with Finder;
-
present the content as your own.
We may block access from a source that does any of these. There is no account to suspend, so blocking is the only measure available and we would rather not use it.
The enquiry forms
Using a form does not create a contract, an offer, a reservation or a commitment on either side. It sends us a message.
What you send should be a professional enquiry. Please do not include:
-
passwords, keys or credentials of any kind;
-
personal data about other people beyond what the enquiry needs — a colleague’s name, if it is relevant, is fine; a list of your users is not;
-
confidential technical information about your institution’s systems that you would not send in an ordinary email.
The reason for that last point is specific and worth knowing: your submission is delivered to us as an email and stored nowhere else, which means it has exactly the security of email. It is a good channel for “does Finder work with our library system” and a poor one for a network diagram.
We answer enquiries as a matter of ordinary business, not as a service level. We do not promise a response time.
Availability
This is a static website on a content delivery platform, so it is unusually reliable, but no site is always available. We may take it down, change it or replace pages without notice, and we do not promise continuity or that any particular page will remain at any particular address.
Content on this site
Product descriptions, figures and the case study are drawn from Idcare Digital’s own documentation and from a real installation. They are accurate as far as we can make them, and they are not a specification. Where a page shows a figure — usage counts, screen sizes, conformity categories — the source is the customer’s own reporting or the product datasheet, and a quotation or contract is what states what you would actually receive.
The demonstration beside the headline on the home page uses example catalogue records chosen to illustrate a search. They are not a claim about any library’s holdings.
Changes to these terms
A change appears here with a new date. Continuing to use the site after a change means you accept it — which is the conventional formula, and on a site with no accounts it is also the only mechanism available, since we have no way to notify you.
Law and jurisdiction
Spanish law governs these terms. See the legal notice for the company’s identification and the jurisdiction clause.
[TO CONFIRM: whether these terms and the legal notice should be one page rather than two. They overlap substantially on a site with no accounts, and two thin pages that repeat each other are harder to keep consistent than one complete one. The information architecture specifies five legal pages; this is a question about whether four is better.]
[TO CONFIRM: your adviser’s view on the automated-extraction clause above. Restrictions on text and data mining interact with Article 4 of the EU Copyright Directive and its Spanish implementation, which requires a machine-readable reservation to be effective — a sentence on a terms page may not be enough on its own.]
